SHERIFF'S SALES

Sheriff's Sales for 2010 will be conducted on Wednesday mornings at 10:00 a.m.  

All Sheriff's Sales are now being conducted on the Lower Level of the Court House.

Sheriff sales are conducted at the Fayette County Court House, 110 E. Court St., Washington C.H., Ohio on the lower level.  NOTE:  This change is effective in December 2009

Sheriff Sales are usually conducted two Wednesdays a month at 10:00 A.M., unless otherwise advertised.    The webpage is for informational purposes only and may not contain the latest information.  Contact the office with any questions.  The official listing of upcoming properties to be sold can be found in the Record Herald (three consecutive weeks in advance of the sale.)

Terms of foreclosure sales are as follow; the property must bring at least two-thirds (2/3) of the appraised value or the property cannot be sold. Ten (10) percent of the purchase price down on the day of the sale, with the balance due within thirty (30) days of confirmation of the sale.  Certified bank drafts or cash money will be accepted.  No personal checks accepted.

ALL SALES ARE CLASSIFIED AS "BUYER BEWARE" AND ARE SOLD "AS IS".  

The property subject to the Sheriff Sale still belongs to the original owner even though the order of sale has been issued from the court. If you purchase a property at Sheriff's Sale, and have a ten percent deposit down, the property still belongs to the original owner until the Common Pleas Judge has signed the confirmation of sale order. This process can take at least 30 to 90 days or more. This is hard for people to understand since they have "bought" the property and placed a monetary deposit. If you have any questions contact your attorney, as the Sheriff's Office cannot offer legal advice.

The Sheriff's Office does not have keys for properties being sold. The bank or lending company should be contacted with questions about an inspection of the property. Questions about utilities should be directed to the company providing services.

Most appraisals of properties were completed without an interior inspection. The Sheriff's Office nor the appraisers are responsible for the condition of the property at the time the purchaser takes possession.

Recent changes in Legislation may require a purchaser to obtain a survey prior to recording a deed. See Ohio Revised Code Section 315.251. The cost of the survey shall be at the purchaser's expense. Q.    Can we see the house?

We have no access to the interior of the houses for sale. No arrangements may be made for an internal inspection of the property. You are urged to check the property as best you can. The Fayette County Auditor can provide a printout on the property showing the numbers and types of rooms, etc. Sales are "BUYER BEWARE". All properties are sold "As Is".  You are urged to consult with your attorney.

Q.    How does the Sheriff Sale work?

By law the sale must be a public sale, unless ordered by the Court. Sales are the second and fourth Friday of the month at 1:00 P.M. at the Fayette County Court House unless otherwise advertised. You or a representative must appear to bid. All bidding is done at the sale. No prior or sealed bids are taken. It works the same as any auction. Make sure you can meet the terms of the sale.

Q.    What happens to the Liens on the property?

Liens are marshaled (placed in order) and paid from the sale proceeds. A Deficiency Judgment is granted to the Plaintiff, against the Defendant, if the sale price is below the judgment amount. The liens are then canceled against the property, with the exception of a Federal Lien. You are urged to check for liens and consult with an attorney if you have further questions. No lien information is available from the Sheriff's Office.  A Title Commitment is filed with the case in the Clerk of Courts Office in the Court House and is available for inspection.

Q.    What if someone is living in the house?

If someone is living in the house and will not vacate, the Sheriff's Office will remove them on an order from the Common Pleas Court entitled "Writ of Possession". You may be responsible for obtaining the Writ of Possession from the Common Pleas Court. Consult with your attorney for more information about the Writ of Possession.

One final warning, large amounts of your money are involved. Sales are Buyer Beware. You are responsible for checking the property and judge for yourself if it is suitable for the purpose you intend. Consult your attorney if in doubt.
